These are the terms and conditions on which you may use our website at http://www.shop4records.com (our “Site”). If you do not want to be bound by these Terms and Conditions then you should not use our Site. By using our site, you confirm your acceptance of these Terms and Conditions and agree to comply with them. The content of these Terms and Conditions should be reviewed each time you visit our Site as we may make changes from time to time.
USING THE SITE
Access to our Site is permitted on a temporary basis and for domestic and private use only. You agree not to use our Site for any commercial or business purposes, we have no liability to you for any loss of revenue, loss of profit, loss of business opporunities or interuption to business operations. Unless agreed in writing directly with Vinyl Works Records Ltd, you must not copy, download or store all or any part of the content of this site with the intention of making the contents available to distribute, sell, and offer to sell or populate a database or publication of any kind.
Although we carefully monitor our Site, we cannot guarantee that our Site, or any individual feature of the Site will be error free, complete, up-to-date, available all the time and/or free from viruses.
All measurements quoted on the site are approximate and the reproduction of colours is as accurate as photographic and production processes will allow.
LINKING TO THE SITE
You may email your friends and family links to our Site or specific pages within it. In doing so, you must act in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link to our Site from any website that you do not own. We reserve the right to withdrawal this persmission to link to another site at any time and without notice.
You must not misuse our Site by committing or encouraging a criminal offence; transmitting or distributing a virus, logic bomb, Trojan horse, worm, time-bomb, keystroke loggers, adware, spyware or post any other material or software which is malicious or harmful to our technology; post messages in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; send any unsolicited advertising or promotional material,or attempt to affect the performance or functionality of any computer systems of or accessed through this Site. A breach of this provision would constitute a criminal offence under the Computer Misuse Act 1990.
You must not use automated computer systems or software to extract data from this Site, a technique known as screen scraping.
CHANGES TO OUR SITE
Our Site and it's integrated processes may contain typographical errors, other errors, inaccuracies, ommissions and content may not be current. We reserve the right to correct any typographical errors, other errors inaccuracies, omissions and change out-of-date content or information at any time without prior notice. If the need arises we may suspend access to our Site or close it indefinitely.
If you register your details on our Site you must treat a log in identification code, password or other security information as confidential and they must not be disclosed to any third party. If you suspect someone else may have access to, or be using your account, you must notify us as soon as possible at email@example.com.
Vinyl Works Records Ltd reserves the right to close an account if any user disrupts or attempts to disrupt any of our services in any way.
We may suspend and/or delete any user account at our sole discretion. We will notify you of our actions by email at the address provided by you at registration. You must not attempt to re-register if your account has been suspended or deleted unless we have authorised you to do so in writing.
You may place an order on our Site providing you are over 18 years old and possess a valid credit or debit card issued by a bank recognised by us. You undertake that you are the authorised user of the credit or debit card used to place the order and that there are sufficent funds available to cover the cost of your order. You also undertake that all details you provide to us during the account opening and/or checkout process are true and accurate.
The display of products on our Site is an invitation and not an offer. By placing an order on our Site you are offering to purchase a product on and subject to the terms and conditions contained on this page and those terms and conditions contained in the other documents/pages/policies referenced on this page. All orders are subject to acceptance, availability and confirmation of the order price. Vinyl Works Records Ltd retains the right to refuse any request made by you and we reserve the right to close your account with us at our sole discretion.
Once you have placed an order on our Site, you will receive an acknowledgement by e-mail confirming receipt of you order. This acknowledgement is not an acceptance of your order. Upon receipt of your order a pre-authorisation check is made on your debit/credit card to ensure sufficient funds are available to complete the transaction. Providing there are sufficient funds available to complete the tranasaction we will approve the order, debit your debit/credit card and despatch the items you have ordered. A contract between us for the purchase of goods will not be formed until we have approved your order and debited your debit/credit card. Ownership of the goods shall not pass to you until we have received payment in full in respect of such products.
If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, by using the details you have provided to us, we will treat the order as cancelled. If you decide to cancel the order and you have already paid for the goods, we will make sure you receive a full refund.
Where applicable, prices are inclusive of VAT. Delivery costs will be charged in addition. Delivery options and costs are displayed during the checkout process and a detailed summary of these options and costs can be found on our Delivery Information page. All risk in the products we supply to you, including risk of any loss or damage, shall pass to you on delivery of the products to the address specified at the time of your order. Delivery times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible.
The price of foreign products and services may fluctuate. All prices advertised are subject to such changes.
We reserve the right to refuse to fill any orders that you may have placed based on information on our Site that may contain, without limitation, typographical errors, other errors, inaccuracies, ommissions or out-of-date information regarding pricing, delivery, payment terms, or returns policies.
Customers taking delivery of goods in the UK, EU, Jersey and Guernsey are entitled to return goods or cancel an order, for reasons other than faulty goods or an incorrect delivery, from the moment you place your order until 14 days after taking delivery of your goods. You must notify us of the goods you wish to return or the order you wish to cancel by e-mail at firstname.lastname@example.org. In addition, you must arrange and pay for the goods to be returned to us within 14 days from the day of sending your e-mail notifcation message. You are advised to keeep your Proof of Postage until we have confirmed receipt of the returned goods. We cannot accept liability for returned goods that are lost in transit.
You must return the goods in a saleable condition meaning that they must be unused and in their original packaging with any tags and seals still attached and intact. We reserve the right to consider the condition of any goods that are returned and make deductions if there is evidence that the goods, its tags or seals have been used, broken or interfered with.
Please note, your right to return a product or cancel an order does not apply to vinyl records when the seal on the outer cover has been broken or tampered with.
Upon receipt of the returned goods we will refund the debit/credit card used in the original transaction, with the cost of the goods that have been returned and the standard delivery charge associated with your original order, we will not cover the cost of any premium delivery options that you selected at the time of the order. We will process refunds within 28 days of recieving the returned goods.
Very occasionally you may experience a problem with your order. Please accept our apologies for any inconvenience caused.
If there is an item(s) missing from your order or you have received a broken or faulty item(s) then please contact us by email at email@example.com, quoting your order number and a brief description of the problem you are experiencing. Our customer services team will then contact you as soon as possible.
The products shown on this website are priced in British Pounds (£/GBP). The exact price charged in local currency to international customers will be determined by the exchange rate applied by the customer's credit/debit card company at the time of the transaction. Refunds are made in British Pounds (£/GBP), the exact amount refunded in local currency to international customers will be determined by the customer's credit/debit card company at the time the refund is processed. International customers accept any losses due to fluctuations in exchange rates and/or foreign currency conversion and/or handling charges made by the customer's credit/debit card company.

Third party trademarks and images of third party products and services featured on our Site are in no way associated, linked or affiliated with Vinyl Works Records Ltd and you should not rely on the existence of such a connection or affiliation. Any trade marks/names featured on this Website are owned by the respective trade mark owners. Where a trade mark or brand name is referred to it is used solely to describe or identify the products and services and is in no way an assertion that such products or services are endorsed by or connected to Vinyl Works Records Ltd.
We shall not be liable for any loss or damage whatsoever, whether in contract, tort, breach of statutory duty, or otherwise, irrespective of whether such loss or damages were foreseeable, arising out of or related to the use, inability to use, performance or failures of our Site or Linked Sites and any content posted thereon.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any content posted on it, or on any website linked to it.
You agree to indemnify, defend and hold harmless Vinyl Works Records Ltd, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs(including, but not limited to, legal fees) arising from your use our Site or your breach of the Terms of Service.
FORCE MAJEURE EVENT
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms and conditions that is caused by any act, event or accident beyond our reasonable control. Our contractual performance is deemed to be suspended for the period of the Force Majeure Event.
Examples of types of Force Majeure Events are: industrial action, civil unrest, terrorist attack, natural disaster, regulations and restrictions by government, failure of the transportation or telecommunications infrastructure.
You agree to imdemnify us fully against all claims, liability, damages, losses, costs and expenses, legal fees arising out of any breach of these Terms and Conditions by you or any other liability arising out of your use of our Site by any person using your account and/or password.
The content on our Site is for general information only and is provided without guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, Vinyl Works Records Ltd and third parties connected to us exclude all conditions, warranties, representations and other terms which may apply to our Site or it's content, whether express or implied.
If any part of our Terms and Conditions is unenforceable, the enforceability of any other part of our Terms and Conditions will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Vinyl Works Records Ltd. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of Vinyl Works Records Ltd.
The Contracts (Rights of Third Parties) Act 1999 shall not apply.
GOVERNING LAW AND JURISDICTION
These terms and conditions are to be construed in accordance with the laws of England and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the English courts.
These Terms and Conditions do not in any way affect your statutory rights.
